These Terms of Service ("Terms") govern your access to and use of the TrendGap website, applications, and related services (collectively, the "Service") operated by TrendGap, Inc. ("TrendGap", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 16 years old and legally able to enter into a binding contract to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Your Account
You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us immediately at support@trendgap.io if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
3. Subscriptions and Billing
Paid plans are billed in advance on a monthly or annual basis and automatically renew until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. All payments are final and non-refundable, including for partial billing periods and unused time, except where required by law. Prices may change with at least 30 days' notice prior to your next renewal.
4. Acceptable Use
You agree not to:
- Reverse engineer, scrape, or attempt to extract the underlying data, models, or source code of the Service in bulk;
- Resell, sublicense, or redistribute TrendGap data, reports, or playbooks as a competing product;
- Use the Service to build, train, or fine-tune a machine-learning model that competes with TrendGap;
- Upload content that is unlawful, infringing, defamatory, or that violates a third party's rights;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
5. Content and Data
TrendGap surfaces insights derived from publicly available signals such as forum posts, app store reviews, and other public sources. We do our best to keep this information accurate, but the Service is provided for research purposes and you are responsible for independently validating any niche, idea, or strategy before acting on it.
You retain ownership of ideas, evaluations, and notes you submit ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, process, and display Your Content solely to operate and improve the Service for you.
6. Intellectual Property
The Service, including its software, branding, niche library, playbooks, and AI-generated outputs presented to you, is owned by TrendGap or its licensors and is protected by intellectual property laws. We grant you a non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal research purposes during your active subscription.
7. AI-Generated Output
Outputs from the idea evaluator and other AI features are generated by language models and may be inaccurate, incomplete, or out of date. They do not constitute legal, financial, or investment advice. You are solely responsible for decisions you make based on AI output.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any niche identified will result in a successful business.
9. Limitation of Liability
To the maximum extent permitted by law, TrendGap and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to these Terms will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service becomes commercially impracticable. Sections that by their nature should survive termination will survive.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will give you reasonable notice — for example, by email or an in-product notice — before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
